1. Scope
1.1 These Terms govern participation in the partner program (affiliate program) of 4mytarot.com between 4mytarot and the partner (affiliate). 1.2 Deviating terms of the partner shall not apply unless 4mytarot expressly agrees to them in writing.
2. Participation and Registration
2.1 Participation is open to natural persons aged 18 or over as well as legal entities. 2.2 Registration takes place via https://4mytarot.com/partner. The partner is obliged to provide truthful and complete information and to keep it up to date (in particular address, e-mail, and payout details). 2.3 There is no entitlement to admission to the partner program. 4mytarot decides at its sole discretion on the approval, rejection, suspension, or blocking of a partner account. 2.4 The partner account is non-transferable. Login credentials must be kept confidential.
3. Services Provided by 4mytarot
3.1 Upon approval, the partner receives a personal discount code and a personal link to share. 3.2 New customers who apply the partner’s discount code during checkout receive a 20 % discount on the selected subscription. 3.3 4mytarot provides the partner with a dashboard showing an overview of redemptions, commissions, and statements.
4. Commission
4.1 The partner receives a one-time commission per referred new customer. The commission amounts to 50 % of the revenue after a flat deduction of 5 % for payment fees (formula: gross amount × 0.95 × 0.50). 4.2 Only the following payments by a referred new customer are commissionable: a) the payment for the trial access; b) the first payment of a monthly subscription; c) the first payment of an annual subscription; d) in the event of an upgrade from the monthly to the annual subscription within 45 days of the first commissioned subscription payment: the difference between the annual subscription commission and the monthly subscription commission already credited. 4.3 No recurring commissions are granted on subsequent payments. 4.4 A new customer is anyone who has not previously had a subscription or trial access with 4mytarot (verified via the e-mail address). Existing customers receive the discount, but no commission is paid. 4.5 A purchase is attributed to the partner exclusively via the applied discount code. No cookie or referrer tracking takes place. The code applied at checkout completion is decisive. 4.6 All commissions are calculated and paid out exclusively in EUR.
5. Release, Settlement, and Payout
5.1 A commission is released when (a) the customer’s payment has been successfully collected and (b) a period of 20 days from the payment date has expired without a refund. Until then, the commission is considered pending. 5.2 Settlement takes place monthly on the 25th. All commissions that have been released by the 24th of the month (11:59 pm) and not yet settled are included. Commissions released later roll into the next monthly run. 5.3 For each settlement, 4mytarot automatically issues a commission credit note (PDF) under the self-billing procedure. The partner does not issue their own invoice. 5.4 Payouts are made to the IBAN or PayPal address stored in the partner account. Payout amounts below €10 are carried over to the following month. 5.5 If a commission that has already been paid out becomes void due to a refund or chargeback of the underlying customer payment, it will be offset as a negative line item on the next credit note. If offsetting is not possible, 4mytarot may demand repayment.
6. Taxes
6.1 The partner receives the agreed commission amount. 4mytarot does not calculate or itemize any value-added tax. 6.2 The recipient is solely responsible for the taxation of the commissions received in accordance with the legal provisions of their place of residence or business. The partner expressly confirms this upon registration. 6.3 If legal or tax requirements necessitate changes to the settlement process, 4mytarot is entitled to adapt the settlement procedure accordingly.
7. Partner Obligations and Prohibited Marketing Methods
7.1 The partner promotes 4mytarot.com truthfully and labels advertising in accordance with applicable disclosure requirements (e.g., “ad”/“advertisement” in social media posts). 7.2 The following in particular are prohibited: a) unsolicited advertising (spam) via e-mail, messenger, or comment functions; b) misleading statements about 4mytarot, its services, or the amount of the discount; c) healing, health, or success promises in connection with the content of 4mytarot; d) search engine advertising on the brand “4mytarot” or typo variants thereof (brand bidding), as well as use of the brand in domains or account names without consent; e) publication of the discount code on voucher and coupon portals without the prior consent of 4mytarot; f) self-purchases via the partner’s own discount code and any artificial generation of sign-ups (e.g., via fake accounts); g) advertising in environments containing unlawful, youth-endangering, or discriminatory content. 7.3 The partner acts as an independent entrepreneur. No employment, commercial agency, or corporate relationship is established.
8. Abuse
8.1 In the event of violations of Section 7 or other abuse, 4mytarot may cancel pending and released commissions that have not yet been paid out, block the partner account, and terminate the contract without notice. 8.2 Commissions paid out unjustifiably may be reclaimed. Further claims remain reserved.
9. Term and Termination
9.1 The contract runs for an indefinite period. Either party may terminate it at any time with 14 days’ notice in text form (e-mail is sufficient). 9.2 The right to terminate without notice for good cause remains unaffected. 9.3 In the event of ordinary termination, released commissions will still be settled and paid out in the regular run. In the event of termination without notice due to abuse, pending and unpaid commissions are forfeited in accordance with Section 8.1.
10. Changes to These Terms
10.1 4mytarot may amend these Terms with effect for the future. Changes will be communicated to the partner by e-mail at least 14 days before they take effect. 10.2 If the partner does not object within this period or continues to use the program, the changes are deemed accepted. In the event of an objection, either party may terminate the contract.
11. Liability and Availability
11.1 4mytarot strives for high availability of the platform and the tracking, but does not owe uninterrupted availability. 11.2 4mytarot is liable only for intent and gross negligence and as required by mandatory law. Liability for the partner’s lost profits is excluded to the extent permitted by law.
12. Final Provisions
12.1 Swiss law shall apply, excluding conflict-of-law provisions. 12.2 The place of jurisdiction, to the extent permissible, is the registered office of 4mytarot. 12.3 Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
